RENTAL AGREEMENT

This Rental Agreement ("Agreement") is entered into by and between Rocket City Backyard & Events ("Company") and the Customer ("Customer") for the rental of foam dart battle equipment.

1. RENTAL EQUIPMENT

The Company agrees to rent to the Customer, and the Customer agrees to rent from the Company, the following foam dart battle equipment (the "Equipment"):

  • Foam dart blasters (quantity based on package selected)
  • Inflatable obstacles and barriers
  • Eye protection gear
  • Team color bandanas
  • Foam darts and ammunition
  • Setup instructions and accessories

Equipment Description/Condition: The Equipment is in good working condition and has been inspected by the Customer prior to rental. Customer acknowledges receipt of all listed Equipment in good condition.

2. RENTAL PERIOD

Late Return Policy: Equipment must be returned by the agreed-upon return time. A late fee of $25.00 per hour (or portion thereof) will be charged for any equipment returned after the specified return time without prior written approval from the Company.

Payment Terms: Full payment is due at the time of pickup. Security deposit will be refunded within 3-5 business days after Equipment return, provided all Equipment is returned in satisfactory condition.

4. CUSTOMER RESPONSIBILITIES

4.1 Equipment Care and Use

  • Customer agrees to use the Equipment only for its intended purpose: foam dart battles and recreational play
  • Customer shall not modify, alter, or attempt to repair any Equipment
  • Customer shall ensure all participants wear provided eye protection at all times during use
  • Customer shall supervise all participants to ensure safe and proper use of Equipment
  • Customer acknowledges that foam darts are projectiles and should not be aimed at faces or eyes

4.2 Equipment Security

  • Customer is responsible for the Equipment from the time of pickup until return
  • Customer shall not sublease, lend, or transfer possession of the Equipment to any third party
  • Customer shall keep the Equipment in a secure location when not in use
  • Customer shall protect the Equipment from theft, loss, damage, and adverse weather conditions

4.3 Inflatable Obstacles

  • Customer agrees to follow all setup and safety instructions provided
  • Inflatable obstacles must be properly anchored and secured during use
  • Obstacles should not be used in high winds or adverse weather conditions
  • Customer shall ensure obstacles are deflated and properly stored after use

4.4 Age and Supervision Requirements

  • All participants must be at least 6 years of age
  • Adult supervision (18+) is required at all times during Equipment use
  • Customer shall ensure all participants understand and follow safety guidelines

5. PROHIBITED USES

Customer agrees NOT to:

  • Use the Equipment for any commercial purposes without written consent
  • Use foam darts or blasters to harm, intimidate, or threaten any person or animal
  • Modify blasters to increase velocity or power
  • Use Equipment under the influence of alcohol or illegal substances
  • Allow Equipment to be used on public property without proper permits
  • Use Equipment in violation of any local, state, or federal laws

6. DAMAGE AND LOSS

6.1 Customer Liability

Customer is fully responsible for all damage to or loss of the Equipment during the rental period, except for normal wear and tear. Customer agrees to pay for:

  • Repair costs for damaged Equipment
  • Replacement costs for lost or irreparably damaged Equipment
  • Cleaning fees for excessively dirty Equipment

6.2 Damage Fees

  • Lost or damaged blaster: $30.00 - $50.00 per unit
  • Lost or damaged eye protection: $10.00 per unit
  • Lost or damaged inflatable obstacle: $50.00 - $150.00 per unit
  • Lost foam darts: $0.25 per dart
  • Excessive cleaning fee: $25.00

6.3 Inspection

Company reserves the right to inspect all Equipment upon return. Customer agrees to allow Company reasonable time to inspect Equipment before security deposit refund is processed.

7. SAFETY AND LIABILITY

7.1 Assumption of Risk

Customer acknowledges that foam dart battles involve inherent risks, including but not limited to:

  • Minor injuries from foam dart impacts
  • Tripping or falling while moving during gameplay
  • Eye injuries if eye protection is not worn properly

Customer voluntarily assumes all risks associated with Equipment use and agrees to hold Company harmless from any claims, damages, or injuries arising from Equipment use.

7.2 Indemnification

Customer agrees to indemnify, defend, and hold harmless Company, its officers, employees, and agents from any and all claims, demands, actions, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to:

  • Customer's use of the Equipment
  • Any injury or damage to persons or property caused by Customer or participants
  • Any violation of this Agreement by Customer

7.3 Safety Equipment

Customer acknowledges the importance of safety equipment and agrees to:

  • Ensure all participants wear eye protection at all times during gameplay
  • Remove participants who refuse to follow safety guidelines
  • Stop gameplay immediately if any safety concerns arise

7.4 Emergency Procedures

In case of emergency, Customer agrees to:

  • Immediately stop all Equipment use
  • Seek appropriate medical attention if injuries occur
  • Contact Company at (770) 310-3639 to report any incidents

8. INSURANCE

Customer acknowledges that Company does not provide insurance coverage for the Equipment or for injuries sustained during Equipment use. Customer is responsible for maintaining appropriate insurance coverage for their activities and agrees that Company's liability is limited as set forth in this Agreement.

9. CANCELLATION AND REFUNDS

9.1 Cancellation by Customer

  • Cancellations made 7 or more days before rental date: Full refund
  • Cancellations made 3-6 days before rental date: 50% refund
  • Cancellations made less than 3 days before rental date: No refund

9.2 Cancellation by Company

Company reserves the right to cancel this Agreement due to:

  • Severe weather conditions
  • Equipment malfunction or safety concerns
  • Force majeure events

In such cases, Customer will receive a full refund or option to reschedule.

10. GOVERNING LAW AND DISPUTE RESOLUTION

This Agreement shall be governed by and construed in accordance with the laws of the State of Alabama. Any disputes arising under this Agreement shall be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved in the courts of Madison County, Alabama.

11. ENTIRE AGREEMENT

This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions, agreements, or understandings, whether written or oral. This Agreement may not be modified except in writing signed by both parties.

12. SEVERABILITY

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
